Terms of Service

This English translation is provided for convenience only. The Polish version of this document is the legally binding one.

Rules for using the ATHLECOR website and online store: orders, prices and payments, delivery, withdrawal from the contract, complaints, personal data.

§1. General Provisions

  1. The online store available at www.athlecor.com (the "Online Store" or the "Website") is run by: ATHLECOR SP. Z O.O. ul. Chodkiewicza 3/21 02-593 Warszawa, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0000963028, REGON: 521633147, NIP: 5213962576, email: athlecor@athlecor.pl, tel.: +48 600 060 819.
  2. Correspondence address / address for returns and complaints: ATHLECOR SP. Z O.O. ul. Chodkiewicza 3/21 02-593 Warszawa.
  3. These Terms of Service set out the rules for using the Online Store, including in particular:
    • the types and scope of services provided by electronic means,
    • the terms of concluding and terminating contracts for services provided by electronic means,
    • the terms of concluding distance sales contracts (orders in the Store),
    • payment and delivery rules,
    • the rules on withdrawal from the contract and complaints (non-conformity of the goods with the contract),
    • the basic rules of personal data processing (details in the Privacy Policy).
  4. These Terms of Service constitute the terms referred to in Article 8(1) of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  5. Use of the Online Store requires reading and accepting these Terms of Service.

§2. Definitions

For the purposes of these Terms of Service, the following terms have the meanings set out below:

  1. ATHLECOR / Seller: ATHLECOR SP. Z O.O. described in §1.
  2. Consumer: a natural person entering into a legal transaction with ATHLECOR not directly related to their business or professional activity; provisions concerning the Consumer also apply to a sole trader treated as a consumer (a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person).
  3. Buyer / Customer: any person (a Consumer or a Trader) who uses the Online Store.
  4. Product: goods offered in the Store (e.g. dietary supplements, sports accessories).
  5. Sales Contract: a distance contract concluded between the Buyer and ATHLECOR.
  6. Order: a declaration of intent by the Buyer aimed at concluding a Sales Contract.
  7. Payment Operator / Autopay: Autopay S.A., with its registered office in Sopot, providing online payment services.

§3. Technical Requirements

  1. Using the Online Store requires: a device with Internet access, an up-to-date web browser, and an active email account.
  2. ATHLECOR applies technical and organizational measures to ensure transaction security (including SSL encryption).
  3. To analyze how the Website is used, ATHLECOR uses Microsoft Clarity, provided by Microsoft Corporation (One Microsoft Way, Redmond, WA 98052, USA). The tool records user behavior on the site, including cursor movements, clicks, and scrolling, and creates session recordings and heatmaps. This data is processed on the basis of the user's consent to analytics cookies (Art. 6(1)(a) GDPR). Consent can be withdrawn at any time through the cookie settings available on the site. Details in the Privacy Policy.

§4. Services Provided by Electronic Means

  1. ATHLECOR provides free electronic services: Customer Account, order form, newsletter, and the option to add reviews.
  2. The Account agreement is concluded for an indefinite period and may be terminated by the Customer at any time by deleting the Account.
  3. The Customer is obliged not to provide unlawful content.

§5. Placing Orders

  1. Orders can be placed 24/7.
  2. To place an Order, the Buyer adds a Product to the cart, fills in the form (address and contact details), selects the delivery and payment method, and clicks the "Buy and pay" (or equivalent) button, which constitutes placing a binding Order with an obligation to pay.
  3. The Sales Contract is concluded when the Buyer receives an email confirming that the Order has been accepted for processing.

§6. Prices and Payments

  1. Product prices are gross prices (including VAT) and are expressed in Polish zloty (PLN).
  2. Available payment methods:
    • Electronic payments (online transfer, BLIK),
    • Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.
  3. Online payments by fast transfer and payment card are handled by Autopay S.A.
  4. If a refund is required for a transaction made by the customer with a payment card, the Seller will make the refund to the bank account assigned to the Buyer's payment card.
  5. Order processing time is counted from the moment the payment is successfully authorized (for card or online transfer payments).

§7. Delivery

  1. Delivery is available within Poland via courier companies or to parcel lockers.
  2. Delivery costs are shown in the Order summary before the Order is placed.
  3. Delivery usually takes 1 to 5 business days from the moment the shipment is dispatched (in accordance with §6(5)).

§8. Right of Withdrawal from the Contract (Returns)

  1. The Consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods.
  2. To exercise the right of withdrawal, an unequivocal statement must be submitted (e.g. an email to athlecor@athlecor.pl or a letter to the correspondence address: ul. Chodkiewicza 3/21, 02-593 Warszawa).
  3. The Consumer must return the goods without delay, no later than 14 days from the day of withdrawal from the contract.
  4. ATHLECOR refunds all payments received (including the cost of the cheapest delivery option) without delay, no later than 14 days from receiving the statement (the refund may be withheld until the goods are returned).
  5. The right of withdrawal does not apply, among others, to goods delivered in sealed packaging which, once opened, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery (e.g. opened supplements).

§9. Non-conformity of the Goods with the Contract (Complaints)

  1. The Seller is liable to the Consumer for any lack of conformity of the goods with the contract under the rules set out in the Polish Consumer Rights Act (Chapter 5a).
  2. If the goods are not in conformity with the contract, the Consumer may request their repair or replacement. Only when repair or replacement is impossible or would involve excessive costs may the Consumer submit a statement on price reduction or withdrawal from the contract.
  3. Complaints can be submitted by email (athlecor@athlecor.pl) or in writing to the correspondence address.
  4. The Seller will respond to a complaint within 14 days of receiving it.

§10. Product Reviews

  1. Product reviews may be published in the Online Store.
  2. Review verification: Reviews are verified. A Product review can only be added by logged-in Customers who have actually purchased the Product in the ATHLECOR Online Store. Verification is automatic: the store system makes the review form available only after an order has been completed.
  3. Posting unlawful, promotional, or vulgar content is prohibited.

§11. Illegal Content Reporting Procedure (DSA)

  1. Any content that violates the law or these Terms of Service can be reported to: athlecor@athlecor.pl.
  2. A report should include a description of the violation and the location of the content. ATHLECOR reviews reports without delay and decides whether to remove the content.

§12. Personal Data Protection

  1. The controller of personal data is ATHLECOR SP. Z O.O.
  2. Data is processed to fulfill orders, operate accounts, and for marketing (with consent). Details are set out in the Privacy Policy.

§13. Final Provisions

  1. In matters not covered by these Terms of Service, Polish law applies.
  2. Customers may use out-of-court complaint resolution procedures (e.g. the ODR platform: ec.europa.eu/odr).
  3. These Terms of Service may change for important legal or technical reasons. Customers will be informed of changes in advance.
